Lahore High Court Protects Home Electricity Connection From Industrial Dues

The Lahore High Court has ruled that a residential electricity connection cannot be disconnected to recover disputed dues from a separate industrial connection.

The Lahore High Court has provided relief to electricity consumers by ruling that a domestic power connection cannot be used to recover outstanding payments linked to a separate industrial connection.

Justice Jawad Hassan issued the decision while hearing a petition filed by Ghazi Akhtar Khan. The court directed the relevant authorities not to take coercive action against the petitioner’s residential electricity connection while the dispute is being considered.

Residential and Industrial Connections Treated Separately

According to the court’s observations, the residential connection involved a separate meter, reference number, billing record and payment history. The petitioner had also been regularly paying his household electricity bills.

The court held that a fully paid residential connection should not be used as a means of recovering disputed amounts associated with a different industrial connection.

Importantly, the court observed that this principle could apply even when both electricity connections belong to the same person.

Court Stresses Consumer Rights

The court also noted the importance of electricity as an essential service connected with the right to life.

Authorities were directed to provide all relevant parties, including the petitioner, with an opportunity to present their position before taking any further action.

Authorities Given Two Weeks

The Lahore High Court directed the concerned authorities to decide the matter within two weeks.

Until a decision is reached on the petition, the authorities have been ordered not to take coercive action against the petitioner’s residential electricity connection.

The ruling provides clarification on the separation of residential and industrial electricity liabilities and offers protection to consumers whose household bills have been paid separately.
